Former Interior CS Fred Matiang’i has moved to a Nairobi court seeking an anticipatory bail after an alleged raid at his Karen home by police seeking to arrest him on Wednesday night.
Matiang’i argues that he faces a looming threat of arrest by police saying that he is justified to be apprehensive that such actions are a violation of his constitutional rights.
The former CS accuses the Kenya Police of misusing and abusing their powers to intimidate him and President Uhuru Kenyatta and their former colleagues in the previous cabinet.
“The powers of arrest by the respondents and the Kenya Police are being abused and misused to harass, intimidate and oppress the applicant and his former cabinet colleagues and the former president; and to achieve extraneous political purposes unconnected with upholding the Law,” Matiang’i argues in his anticipatory bail application.
Matiang’i claims he was in possession of credible information from his sources at Kenya Police on a plan to arrest him arbitrarily and arraign him for “ulterior political motives.”

The former CS argues that if the court does not grant the orders, he will continue to live in fear together with his family and close friends not knowing when they will be arrested.
His lawyers say he wants the city court to issue conservatory orders barring any Kenya Police officer from arresting, charging, harassing or interfering with him in any way.
The former “Super CS” also wants the government and police barred from nabbing him without a probe and being given a chance to be heard or summoned to record a statement.
Matiang’i insists that police raided and surrounded his home in Karen, Nairobi on February 9, 2023 with an intent to apprehend him but left when his lawyers and the media arrived.
“The applicant has never been summoned to appear before any police station or investigative agency and no arrest warrant had been issued against him, a clear breach of due process,” the court papers read.
He has linked his woes to the remarks he made at the home of his former cabinet counterpart, the late former Education CS Prof George Magoha in Lavington, Nairobi.
“The Applicant is aware that his woes got worse when he gave a speech at the home of the late Prof Magoha where he shared the lessons on public service that he had learnt from the deceased.
“His security was withdrawn the next day and the impending arrest is part of the scheme to harass and silence me forever.”
While eulogizing Prof Magoha at his home last week, Matiang’I accused the President William Ruto administration of taking credit for projects initiated under Uhuru Kenyatta.
