The High Court has stamped out Section 22 of the Election act that requires all aspirants seeking to vie for MCA positions to have a university degree.

The court declared that piece of law unconstitutional on Friday.

The court cited lack of public participation in enacting the provision.

Former President of the Law Society of Kenya (LSK) Tom Ojienda and some lobby group had moved to court seeking to quash the law demanding MCA aspirants to have university degrees.

In Ojienda's submission, section 22(1) of the elections act is unco9and contravenes Articles 27 and 28 of the constitution of Kenya 2010.

The 2022 elections are now expected to attract more aspirants for MCA's position as aspirants without Degree Qualifications are free to vie for elective posts in the 2022 elections.
