Adrian Gilbert Muteshi, who in June 2013 won a milestone case against Deputy President William Ruto on the grabbing of his land during the 2008 poll violence, has died.  

According to an obituary from his family published in the Daily Nation on Wednesday, Muteshi died on Tuesday at the age of 86.

However, the obituary by the family of the of the former Personnel Manager with the defunct East African Airways did not reveal what caused his sudden death.

In June 2013, the court ordered DP Ruto to pay Sh5 million to Muteshi, who was forcefully evicted from the parcel in 2008, for illegally occupying his land.

Muteshi accused the former Eldoret North MP of plotting to grab his 100-acre farm in Uasin Gishu during the chaos that rocked Kenya after the contested presidential poll.

The High Court sitting in Nairobi ruled that Muteshi had proven beyond reasonable doubt that the land belonged to him and was grabbed from him.

But the DP argued in court that he did not know the land was grabbed when he bought it and that he conducted due diligence before the purchase. 

A bid for an out-of-court settlement flopped after Muteshi demanded that Ruto compensates him for lost revenue during occupation and meets the cost of the suit.

In her ruling, Lady Justice Rose Ougo ruled that the land was fraudulently subdivided and sold to Ruto but did not find him culpable for the irregular dealings.
