Tourism Cabinet Secretary Alfred Mutua has condemned the recent attack on Pinewood Beach Resort in Diani, Kwale County, promising swift government action against those responsible.

Speaking on Monday, Mutua expressed his concern about the violence orchestrated by hired goons, emphasizing that such behaviour against hotels and restaurants would not be tolerated.

“I have noted with concern the violence at Pinewood Beach Resort by hired goons. This behavior by receivers and auctioneers against hotels and restaurants will not be tolerated. Stern action is being taken. Upholding of the law and civility are key to encourage and not deter visitors,” Mutua declared.

The resort, facing a takeover bid by the Kenya Commercial Bank (KCB) over a Sh5 billion loan for a luxurious property in Mombasa, has obtained an injunction order against the lender, with a court hearing scheduled for January 9, 2024.

Pinewood hotel owner and Managing Director Alnoor Kanji accused a receiver-manager from the local bank of orchestrating the violent attack. In a statement on Sunday, Kanji revealed that the assault had not only caused injuries but also instilled fear among guests currently holidaying at the facility.

"Without the protection of armed police and the courage of our staff, this may not have been the case. Tourist police had to intervene with gunfire while our staff were forced to fight the attackers head-on," Kanji disclosed.

Despite having a court injunction preventing any party from taking over the hotel, Kanji expressed concern that unlawful and forceful attempts to gain possession might persist.

“We fear that despite attaining a clear court injunction to prevent any party from taking over, they will continue to unlawfully and forcefully gain possession,” Kanji stated.

The ongoing dispute revolves around the Sh5 billion loan acquired for the construction of a luxurious property in Mombasa linked to the Kanji family.

Kanji called for a thorough investigation into the actions of the KCB receiver-manager, alleging their involvement in organizing the attack.

“What they have done is illegal, criminal and with no regard for human life, let alone the reputation of Kenya,” Kanji added, as the hotel continues to grapple with the legal battle amidst escalating tensions.
