A city court has awarded former State House digital, innovative and diaspora director Dennis Itumbi a sum of Sh630,000 for unfair dismissal by President Uhuru Kenyatta government.

Labour Court judge Jacob Gakeri on Thursday ruled that the Uhuru administration failed to comply with the Employment law even though it was justified to declare Itumbi redundant.

According to the judge, the vocal digital media strategist wished to be a government employee up to October 2022 but his job was terminated after five years and eight months.

The court established Itumbi had been hired on July 9, 2014 but was never supplied with any disciplinary or warning letter and was never involved in his employment being terminated.

“The respondents may have had a valid and fair reason to terminate the petitioner’s employment but did not comply with the requirements of the provisions of the Employment Act, 2007, to guarantee procedural fairness in the process,” ruled Justice Gikeri.

Itumbi was fired in March 2020 on grounds of scrapping of his office due to what was said to be a re-organisation by the President Uhuru administration.

It was then that he rushed to court to challenge the decision accusing the Public Service Commission (PSC) of declaring him redundant based on orders from then Interior CS Fred Matiang’i.

In its defence in court, PSC denied the claims by Itumbi arguing that State House had intended to establish a new post for him under the then Presidential Delivery Unit (PDU).
