The High Court in Nairobi has reinstated Mercy Wambua as the CEO, Law Society of Kenya (LSK).

This has come months after LSK sent Wambua on a compulsory leave during a special general meeting held in June.

The meeting was held to discuss Wambua’s tenure and audit of the society’s financial records.

A ruling delivered on Monday by Justice Anthony Mrima quashed resolutions of the meeting which include suspension of the CEO.

The court also declared the caretaker council formed during the meeting illegal.

Mrima said that even with the election of the council, general membership remains save for Roseline Odede’s following her resignation.

Mrima also noted that the purported general meeting was held contrary to a court order that directed the matter to be taken to arbitration.

The parties were instructed to convene a council meeting within 21 days.

The court has also ordered the caucus chair to take over the functions of the council should the council remain dysfunctional and unable to conduct business.

Wambua's reinstatement has dealt a blow to LSK President Nelson Havi with whom Wambua has been at loggerheads since Havi became LSK President.

Havi accused Wambua of involvement in embezzlement of the society's funds.
