A petition has been filed by one Memba Ocharo before the Judicial Review Division, seeking to compel the Directorate of Criminal Investigations to arrest businessman Jimi Wanjigi for possession of illegal firearms.

Ocharo argued that Wanjigi’s conduct has been questionable previously, therefore he should not possess the firearms.

He said through his lawyer Danstan Omari that Wanjigi who was once an Inspector of Police was stripped of all his police powers and ordered to surrender all firearms and ammunition he had, following several complaints and incidences allegedly about Wanjigi misusing the firearms threatening and intimidating members of the public.

According to the court documents presented by Ocharo, the Firearms Licensing Board is yet to conduct due process to have the businessman’s firearms certificate procedurally revoked according to the ruling in the case of Republic versus Firearms Licensing Board & another; Ex parte Jimi Wanjigi (2019).

"Wanjigi will soon receive the firearms and ammunition that were initially confiscated yet the Firearm Board has never conducted a due process that is in accord to the law to have Wanjigi firearms certificate procedurally revoked in a manner anticipated in the ruling of this court in Republic v Firearms Licensing Board & another; Ex parte Jimi Wanjigi[2019]," the court papers read.

Ocharo claims Wanjigi had been a licensed firearms holder until January 30, 2018, when the Firearms Licensing Board revoked his certificate, long after he was discharged from his duty in the Police Service for misuse of the firearms.

Ocharo’s petition comes when Kinoti’s date with Kamiti Maximum Prison is still hanging in the balance after High Court declined to set aside his four-month prison sentence.
