Justice Juma Chitembwe has ruled that Keroche heiress Anerlisa Muigai pays her ex-boyfriend Ben Kangangi a sum of Sh2 million in a defamation case.

Kangangi sued Anerlisa over Facebook and Instagram posts she made in 2018, which he felt were defamatory.

Going by the social media posts, Anerlisa said Kangangi could not be trusted, as he was allegedly an unscrupulous businessman who conducted fraudulent businesses.

Kangangi told the court that Anerlisa’s posts harmed his business and tainted his reputation.

He wanted Anerlisa to pay for the damages and offer a written apology.

Chitembwe weighed the evidence that was presented before him and found Anerlisa guilty of defamation after failing to prove the assertions she made on her social media posts about Kangangi were true.

“Given the evidence on record, it is this court’s view that it was indeed defamatory. The post directly referred to the plaintiff and indicated that he was an unscrupulous businessman who conducted fraudulent businesses and could not be trusted,” the court said.

According to the ruling, the plaintiff indicated that the claims by the defendant were false and that the defendant did not provide anything to convert the same.

“Given the evidence on record, I do find that a global award of Ksh2,000,000 shall be adequate compensation for the plaintiff. The plaintiff is hereby awarded Ksh2million as general damages plus costs and interest,” Chitembwe ruled.
