Nairobi County’s Karen MCA David Mberia has lost his seat after being jailed for three years for demanding a Sh1.7 million bribe from a city school in a land dispute.
Mberia has been fined Sh700,000 by the court for receiving the bribe to resolve a land row involving the city school.
Prosecution said in court that the MCA had demanded and received the inducement from owners of the Kiragu Waichahi School located in Pumwani Ward, Kamukunji Constituency.
However, Mberia’s two co-accused in the bribery case were acquitted by Magistrate Thomas Nzioki on grounds that the prosecution failed to establish a case against them.
The magistrate ruled the MCA be barred from holding public office or accessing his office, with the court decision expected to be communicated to the County Assembly speaker for action.

“You will now loose the county seat. A copy of this judgement will be forwarded to the Speaker of the Nairobi County Assembly for action and implementation,” ruled Magistrate Nzioki ruled.
He was sentenced on three counts of soliciting for a bribe and receiving treated cash from the Ethics and Anti-Corruption Commission (EACC) and will surrender office as outlined in the Anti-Corruption and Economic Crimes Act.
Mberia solicited Sh1 million from Samuel Maina Kiragu to influence the outcome of a probe conducted by the Culture and Social Services Committee over the ownership of the school land.
He further demanded a half a million-shilling brobe from Kiragu on April 25, 2019 and was also charged with collecting an inducement of Sh200,000 from him.
