Kenya Tea Development Agency (KTDA) and its CEO Wilson Muthaura have written a demand letter to Kenyan blogger Cyprian Nyakundi threatening to sue him for defamation.

Through their lawyers from JK Kibicho and Co. Advocates, KTDA and Muthaura are accusing Nyakundi of publishing on his website and Facebook pages stories injuring their reputations.

In the demand letter, the two entities say the blogger made a “scandalous and defamatory” post on his verified Facebook page on December 24, 2022 against the KTDA Chief Executive.

“The disparaging post was not only false but injurious to our clients reputation and character. You also made this post knowing very well that the same was false,” read the demand letter signed by Ramadhan Abubakar.

KTDA and Muthaura say Nyakundi on December 28, 2022 published another Facebook post that made “several falsified allegations which are defamatory” directing people to his site.

“The contents of the Facebook posts and blog post are defamatory, a falsehood, inaccurate and made with malicious intent to paint out client in bad light.

“These malicious Facebook posts and article by yourself have negatively portrayed the company and its leadership, especially among tea farmers who are the major stakeholders in the KTDA value chain.”

In that regard, KTDA and Muthaura have given the blogger 12 hours to publish an apology on the same platforms and retract the offending posts and article or be taken to court.

They also demand that Nyakundi deletes all posts they deem offensive within 12 hours after receiving the letter and stop making any further malicious statements about their clients.

“TAKE NOTICE that if you do not comply with the demands herein, we have instructions to seek legal redress against you without further reference to you and at your risk as to costs and other consequences ensuing thereof,” concluded the letter.
