A woman has sued Nairobi tycoon Jimnah Mbaru for upkeep claiming that the wealthy businessman had abandoned all his parental responsibilities for their minor child.

In an affidavit filed at the Nairobi Children's court, the said woman is demanding a monthly upkeep of Sh320,000 and Sh600,000 each year in school fees for the three-year-old minor.

According to the suit, the woman says the amount will cover rent, shopping, transport, security, clothing, housekeeping, entertainment, medical cover, education, and utilities.

The court papers filed through Nairobi lawyer Suyianka Lempaa alleges that the 24-year-old woman was with Jimnah Mbaru sometime in 2017 leading to the birth of her son in 2018.

She claims the businessman later gave the power of attorney to another man to act as a reputed father to assume the responsibility of a father to the minor in the affidavit.

The woman continues to claim in the court papers that the putative father was needed to pay Sh50,000 monthly in child maintenance, an amount she says has never been remitted.

She further alleges in court that Mbaru refused to have his name incorporated in the minor’s birth certificate as his biological father hence denying her son his paternal identity.

“That on 1st September 2020 the 1st respondent instructed and gave power of attorney to one Eric Murimi Kaburu to be a putative father to the minor terms of which are not known in any law including the constitution of Kenya,” the court papers filed by the woman reads.

She argues that her son will suffer irreparably if the court does not grant her the demands claiming that Mbaru was a man of means hence able to support the minor boy with ease.

The woman is further demanding a DNA test done and Kaburu barred from acting as her son’s putative father saying it will affect his physical, mental and emotional well-being.
