Machakos Governor Dr Alfred Mutua has suffered yet another major blow after the registrar of companies reinstated his ex paertner Lilian Ng'ang'a's shares in the hotel ownership dispute.

Mutua wanted edge out Lilian from the ownership of Ndash Enterprises Limited, the company that owns A&L Hotel in located in Machakos County.

However, Lilian filed a complaint with the registrar after she fell out of favour with Mutua who alleged to have reallocated 1,800 shares she owned in the company.

Ng'ang'a's lawyer Philip Murgor  said the registrar found the complaint merited since the transfer of the shares was fraudulent.

"...and has reversed the entry in the company and the fraudulent transfer of the 1800 shares," Murgor said.

The registrar's letter said its investigation concluded that Lilian did not initiate the transfers of the shares nor was she aware of the same.

"The registrar finds that there is a reason to invoke the provisions of section 862 of the companies Act 2015, and thereby notifies the parties that the impugned changes have been expunged from the register and the ownership of the company restored to the shareholding prior to the changes lodged with the registrar on August 11, 2021," the letter reads. 

According to documents at the registrar, the updated hotel ownership details indicate that both Mutua and Lilian own 2000 shares each.

Lilian has asked the Directorate of Criminal Investigations (DCI) to probe the criminal transfer of her shares.

She also reported that Mutual took possession of her car and fraudulently transferred its ownership from her.

Murgor said his client is hopeful the DCI will expeditiously conclude investigations into the fraudulent transfer of shares and car ownership details.

“Ng’ang’a remains hopeful that the investigations by the DCI into the criminal aspects of the fraudulent transfer of her shares and her motor vehicle can be concluded expeditiously and [the file] forwarded to the DPP for appropriate action,” Murgor said.
Mutua and Ng'an'ga announced they were ending their long-term relationship in 2021 after spending almost a decade together.
This fresh development comes just hours after the Registrar of Political Parties threw out his application seeking to withdraw his Maendeleo Chap Chap (MCC) party from the Azimio la Umoja One Kenya Coalition.
