The Judicial Service Commission (JSC) has approved the removal of Justice Said Juma Chitembwe from office over allegations levelled against him of gross misconduct.

This was announced through a press statement by the commission that was released on April 28, 2022.

According to JSC, it received Petitions seeking the removal of Chitembwe on allegations of impropriety and gross misconduct.

Further, the Commission on its own motion started proceedings for the removal of Chitembwe from office pursuant to the provisions of Article 168 (2) of the Constitution.

JSC notified the public that the panel that was formed to consider the petitions was satisfied that the petitions disclose grounds for the removal of Chitembwe.

“The Commission would like to notify the public that the panel constituted to consider the Petitions concluded its work and presented its report to the full Commission for deliberation. At its meeting of 27th April 2022, the JSC considered the report of the panel on the petition initiated by the commission on its own motion, and is satisfied that the Petition discloses grounds for the removal of Hon. Mr. Justice Chitembwe Said Juma from office, pursuant to the provisions of Article 168(1) of the Constitution,” the statement read.

The commission also said it has resolved to send the petition to President Uhuru Kenyatta for further action.

“Accordingly, the Commission, resolved to send the Petition to His Excellency the President for his further action in accordance with Article 168(4) of the Constitution,” the statement read in part.
