The High Court of Nairobi has dismissed the case, challenging the Political Parties Amendment Act, 2022.

A 3-judge-bench comprising Justices Hedwig Ong’udi, Daniel Ogembo and Esther Maina made a ruling on Wednesday that the Bill that was signed by President Uhuru Kenyatta into law early this year was constitutional.

The petition filed by one Salesion Mutuma Thuranira sought to have the law suspended on grounds that it threatens the political rights of Kenyans and the Independent Electoral and Boundaries Commission (IEBC).

The three judges held a different opinion with the submission that the National Assembly passed the Bill before being taken through the public participation process.

The judges said the process of public participation to amend the act started back in 2017.

According to the court’s verdict, several stakeholders were part of various forums that were attended by members of civil societies and the Secretaries-General of all political parties.
