The High Court has issued an order to the government to allow controversial revolutionary Miguna Miguna to come back to the country.

This follows a spirited legal battle Miguna’s legal team staged to have him into the country.

Justice Hedwig Ong’udi directed that Miguna obtains emergency travel documents from any embassy or high commission close to him within seventy-two hours.

The judgment was delivered via a virtual court session on Monday.

Ongu’udi also directed Air France or other airlines to allow Miguna to board their planes to Kenya upon presentation of his travel documents.

The court also ordered the Immigration Department to allow Miguna to use his identity card as he travels and issue him with a passport within seven days.

Miguna has also been asked to apply for a passport afresh as soon as he lands in Kenya.

“I order you to facilitate the entry of Miguna into Kenya. Anyone who is not satisfied by the Directions has the right of appeal,” Ong’udi ordered.

This comes as a victory for Miguna’s legal team, which includes established and renowned lawyer John Khaminwa.

Khaminwa thanked the court for giving the order to allow Miguna to come into the country.

“Thank you for the order you have given today, Your Honor. We hope things will work this time,” Khaminwa said.

Last week, Miguna’s attempt to come into the country was rendered futile after Air France officials at Berlin’s Brandenburg Airport informed him that the Kenyan government has issued a ‘red alert’ against him.

The Law Society of Kenya (LSK), LSK president Nelson Havi and former Chief Justice Willy Mutunga have moved to court to compel the court to issue orders to allow the controversial lawyer and revolutionary Miguna Miguna’s return to the country.
