Director of Public Prosecutions (DPP) Noordin Haji has dropped some charges against key suspects in the Sh63 billion case linked to former Treasury Cabinet Secretary Henry Rotich over the Kimwarer and Arror dam case.

In a new application presented in court under a certificate of urgency, the DPP amended the charge sheet, relinquishing some names of key suspects related to the awards of tenders for the construction of two dams by Italian firms.

The new charges claim that managing director David Kimosop and senior officials of Kerio Valley Development Authority (KVDA) others failed to comply with the competitive bidding for the project's tender as stipulated by the law.

Initially, Rotich had been charged with engaging the collapsed Italian Construction company CMC Di Ravenna.

The Italian firm went bankrupt months after receiving Sh7.2 billion in advance payment for the non-existent project.

The latest move by the DPP comes when Rotich has filed a petition in the High court arguing that the charges against him were premised on the wrong assumption that he was the one who approved the project.
