Senator Mithika Linturi of Meru has moved to court to bar his impending arrest and prosecution over attempted rape allegations.

Linturi disclosed he received a letter dated May 5, 2021, written by the Directorate of Criminal Investigations (DCI) indicating that his arrest over the attempted rape charges was imminent.

The senator, however, argues that the alleged offence has never been disclosed to him.

According to the DCI document, a woman complained about Linturi for allegedly trying to rape her at Maiyan Villas Hotel in Nanyuki.

On January 29, 2021, the woman, her husband and their friends went to Maiyan Villas Hotel. Later in the night, the woman retired to bed, leaving the door open for her husband who was still enjoying the company of his friends.

She heard a knock on the door at around 3 am and assumed it was her husband. She got alarmed when the person who entered the room started got into bed and started touching her in a manner she did not recognize.

“At about 3 am she heard the door unlocked and since the lights were switched off she assumed it was her husband and the person got into her bed and started touching her in a very unusual manner,” DCI report reads.

The person remained silent and continued with his quest even as the woman told him to stop before they both fell asleep.

After another 30 minutes, she heard another knock on the door and went to open it only to find her husband standing outside the door. 

Confuses as ever, the woman switched on the lights only to discover a stranger in their bed.

“Thirty minutes later she heard a knock on the door and went to open the door only to find her husband standing at the door prompting her to switch on the lights since she was confused about who was in her bed whom she thought was her husband,” the woman stated.

The woman’s infuriated husband raised alarm upon the discovery, and their friends who identified Linturi responded.

They also established that the senator was also a guest in the same establishment.

Linturi allegedly proposed an out-of-court settlement of the matter, offered Sh200,000 in cash, and then wrote another Sh800,000 cheque.

However, Linturi somersaulted the couple when he went to the Laikipia DCI and reported a case of extortion instantly turning the tables and rendering the couple suspects.

Linturi has been hitting the headlines for all the wrong reasons, including arrest and court cases.
