The replacement of former Wajir Governor Mohamed Abdi Mohamud has been stopped by a Meru High Court after his impeachment by the senate.
An application by 5 Wajir County residents; Bishar Ahmed, Aden, Ibrahim, Yusuf Ibrahim, Safiya Mahammed and Omar Jele through their lawyers, sought the nullification of the impeachment.
Justice Patrick Jeremy Otieno of Meru High Court stopped the swearing-in of Ahmed Mukhtar; the Wajir Deputy Governor to assume duties of the Governor until after the hearing and determination of the case filed by the 5 Wajir County residents.
Otieno also suspended the implementation of the May 17, 2021, Kenya Gazette notice in which the announcement of the senate’s resolution to impeach the governor on charges of abuse of office was made.
The Wajir County residents, through their lawyer Ndegwa Njiru, Ndegwa Mwangi and Kiogora Mwangi argued that the High Court had issued orders to the Senate on April 29, 2021, to stop the Senate from discussing the Wajir County’s resolution to impeach Abdi.

The senate, Speaker Kenneth Lusaka, Speaker Ibrahim Ahmed, Abdullahi Issack (MCA Tulatula) Wajir County Assembly and the assembly’s clerk Shalle Sheikh were named as respondents in the case.
The petitioners were also allowed to amend their initial application to include Mukhtar, the chief registrar of the High Court and the Committee, Assumption of the Office of the County Governor as stakeholders.
Otieno said that a judge should not be allocated by the chief registrar of the high court to swear in Mukhtar as the new Wajir County Governor and the committee should not gazette the date and time of the swearing-in event.
The case between the parties is set to be heard on June 3, 2021
