Two fraud cases worth Sh5.9 million against car dealer Joseph Kairu Wambui, popularly known as Khalif Kairo, have collapsed after the complainants accepted refunds and abandoned the prosecutions.
The withdrawal was announced on Monday at Milimani Law Courts, where Chief Magistrate Lucas Onyina confirmed that the parties had reached a private settlement.
Kairo’s defence team explained, “My client has refunded the complainants through their advocate, and they are not pursuing the cases further.”
Acting on that submission, the magistrate applied Section 204 of the Penal Code, which permits criminal charges to be terminated once disputing parties agree to settle outside court.
Court filings show that in one of the complaints, Kairo’s company, Kai & Karo Limited, was accused of receiving Sh2.98 million from Dona Ayalo Okoth between July and November 2024 for the importation of a Subaru Outback.

In the second matter, Jeff Kyule Munane claimed he paid Sh2.15 million for the purchase of a Honda Vezel Hybrid from Japan, but no car was supplied.
Kairo, who had initially pleaded not guilty to the charges, has consistently rejected any suggestion of fraud.
Although the two concluded disputes have now been taken off the court roll, another case remains unresolved.
Negotiations are said to be ongoing, with the matter set for mention in December 2025.
The businessman, who rose to prominence through social media marketing and bold online campaigns in Kenya’s car import industry, continues to defend his name.
Still, the string of legal battles has clouded his reputation in a sector where trust is central.
