The High Court has quashed Murang’a Woman Representative Sabina Chege’s 2017 polls ‘rigging’ utterances case.

Justice Antony Mrima stopped the Independent Electoral and Boundaries Commission (IEBC) from hearing the case further.

Mrima quashed the summons that the IEBC Disciplinary Committee issued to the Woman Rep to appear before it.

In his ruling, Mrima said the IEBC Committee is not mandated to issue such summons.

The court also held that the commission’s Code of Conduct is not applicable since candidates have not been determined to subscribe to it.

The commission had summoned Sabina for examination over utterances of alleged involement in rigging the 2017 elecgtion she made at a rally in Isibuye, Vihiga County.

Chege, through her lawyers James Orengo and Otiende Amollo, moved to court to stop the hearings by IEBC arguing that it had no grounds to hear the matter since she had not officially submitted any papers indicating she will vie in the August election.

She also argued that IEBC had commenced her prosecution in bad faith, accusing the electoral body of hastily embarrassing and tarnishing her reputation.

Chege said the commission had a premeditated verdict to bar her from vying in the August general elections if he declared her interest to run for a seat.
