The suspects in the 2013 NYS scam that led to the loss of Sh105 million Ben Gethi, his co-director Joyce Makena and two other accomplices have been found guilty of forgery.

Chief Magistrate of the Anti-Corruption Court Lawrence Mugambi found the IEBC officials accused of forging 2013 Poll materials.

Mugambi found the four individuals liable for the offence and ordered their remand at the Industrial Area Police Station.

While delivering his conviction, Mugambi said the four devised a plan to alter tender documents for personal gains, and that led to the loss of Sh147 million.

The initial tender by Solarmark Technologies showed Sh105 million, and they altered it to read Sh147 million.

According to Mugambi, the Procurement officer one Gabriel Ngonyo Mutunga was the mastermind of the scheme.

"Gabriel Ngonyo Mutunga who was the procurement officer, was the mastermind of the lethal scheme which gave rise to the loss," Mugambi said.

Gethi and Makena were also convicted for forgery of tax compliance certificate issued by the Assistant Commissioner of the domestic tax department at the KRA

Former IECB clerks Abdi Elena Ali and Akan Adano Katello were acquitted by Mugambi because of lack of sufficient evidence.

The four will be sentenced on Tuesday afternoon.
