Tom Mboya, the man who had been accused of attempting to kill Ranalo Foods restaurant owner William Osewe, has been found guilty.

The Milimani Law Court's Chief Magistrate Martha Mutuku ruled that the prosecution had a case against Mboya noting that the offence is usually committed when there is intent by a person to kill another. 

While delivering the judgment, Mutuku noted that the evidence before the court proved that the accused shot Osewe four times.

"I have considered the evidence before the court and it is not in dispute that Mboya shot Osewe. He did so not once but four times," ruled Mutuku.

She indicated that the prosecution had proven the first count against the accused and found him guilty, while dismissing a challenge by the defence lawyers.

"I dismiss the defence as the prosecution has proved count number one and found him guilty of the offence under Section 215 of the CPC," added the judge.

The magistrated ordered that the accusedbe held at the Industrial Area remand in Nairobi as he awaits pre-sentencing on October 4.

Mboya was accused of shooting Osewe following a scuffle over a woman, who was said to be the latter's wife, on December 1, 2016 after the restauranter accused the accused of sleeping with his wife.
