A Nairobi court had denied The Directorate of Criminal Investigations (DCI) the access to the CCVT footage that captured the alleged police raid on former Interior CS Fred Matiangi’s home on February 9, 2023 at night.

The case investigating officer, identified as Eunice Niue through an application on February 10, 2023 sought to have the court issue an order to Amsec Security Services, which is the security firm that is in charge of security at Matiangi’s Karen home.

Niue specifically requested CCTV footage from 6:00 a.m. on February 8 to 11:00 a.m. on February 9, 2023.

“That an order be and is hereby issued compelling the manager of Amsec Security Services Limited (the Respondent), in person or through a nominee, to extract and avail to the Applicant, through No. 235834 C.1 EUNICE NIUE, a police officer and an investigator attached to County DCI Headquarters Nairobi (Applicant), with the footages for the period between 6:00am on 8th February, 2023 and 11:00 on 9th February, 2023 captured by the Closed-Circuit Television (CCTV) installed and or controlled by the Respondent at the residence of lion. Dr Fred Matiang’i the former cabinet secretary of Interior and National Security,” the court document read.

According to the DCI, they need the said CCTV footage to help the investigate an alleged attempted robbery incident.

“THAT, preliminary established that the said residential Karen Ngong view within Karen is covered by CCTV cameras manned by the respondent and therefore there is need to retrieve the same for evidential purposes," the DCI said.

However, the court denied the DCI’s application and instead ordered the matter to be mentioned on March 7, 2023.

This comes after the former CS moved to a Nairobi court seeking bail after an alleged raid at his Karen home by police seeking to arrest him on February 8, 2023.

Matiang’i accused the Kenya Police of misusing and abusing their powers to intimidate him and President Uhuru Kenyatta and their former colleagues in the previous cabinet.
