The Office of the Director of Public Prosecutions (ODPP) has disputed former Nairobi Governor Mike Sonko’s acquittal in the Sh20 million graft case by the Anti-Corruption Court.

Anti-Corruption Court magistrate Douglas on Wednesday delivered the ruling that acquitted Sonko, saying the prosecution failed to prove the case against Sonko beyond a reasonable doubt.

The ODPP seems to have varying opinions and said it would appeal against Ogoti’s ruling.

According to the ODPP, the court only acquitted Sonko on the grounds of a defective charge sheet and not on merits or the case’s substance.

“The ODPP will appeal against the ruling of Hon. Ogoti delivered today, acquitting all accused persons in the case of the former governor of Nairobi and others. The court acquitted on the basis that the charge sheet was defective, and not on the merits and substance of the case,” the ODPP said.

In the case against Sonko in which he alongside others were charged with the offence of conspiracy to commit an offence of corruption, conflict of interest, money laundering and acquisition of proceeds of crime, ODPP says it called 19 witnesses and produces 113 documents to support its case.

“The prosecution called a total of 19 witnesses and produced 113 documentary exhibits in support of its case and closed its case on 27th July 2022,” the ODPP said.

ODPP’s latest stand on the case could mean Sonko may not be out of the woods yet.
