Former Malili Ranch board Chairman David Ndolo Ngilai on Thursday admitted to signing a land sale and transfer agreement resulting in a Sh1billion fraudulent sale to the government for the development of Konza City.
Ngilai admitted to approving the sale of 5,000 acres of land to the Ministry of Information and Communication between February 2, 2009 and January 11, 2010 minus the resolution of shareholders.
During cross-examination by prosecution, the first accused person said he signed the transfer deal despite knowing the government had bought purchased the said land.
Ngilai told the court that the government’s Sh1 billion compensation for acquiring the land for Konza Technopolis was received through the bank account of advocate Erick Mutua.

He said Malili ranch board approved payment of Sh28 million in legal fees and others for valuers hired to evaluate the property of those who had settled and developed the land without a resolution of the members.
Malili Ranch directors Ngilai, Leonard Kyania Kitua and Julius Mbau Nzyuko are facing six counts of conspiracy to defraud, stealing Sh553, 831,731 proceeds of the ranch land sale and breach of trust in the sale of the land without the approval of the shareholders.
Prosecution led by Geoffrey Obiri and Vincent Monda presented 31 witnesses in court to prove its corruption case against the three former Malili Ranch Limited directors.
The defense hearing is scheduled to continue before Milimani Anti-Corruption Court Chief Magistrate Lawrence Mugambi.
