Independent Electoral and Boundaries Commission (IEBC) Commissioner Justus Nyang’aya has disclosed that a foreigner and three IEBC officials intercepted forms 34A in the IEBC portal and manipulated the results.
Nyang’aya said this in his affidavit while responding to the ongoing Presidential Election Petition filed by Azimio la Umoja One Kenya coalition leader Raila Odinga and his deputy Martha Karua at the Supreme Court in which he is listed as the Sixth respondent.
He disclosed that he was charged to handle only protocol issues even though IEBC appointed him to be in charge of ICT which he said was contrary to his expectations since he thought he would be in the middle of all discussions and negotiations with all the third clients who were meant to provide ICT services to IEBC.
Nyang’aya listed a foreign national in his affidavit by the name Gudino Omor as one of the persons who were involved in retrieving uploaded results from polling stations and replacing them with manipulated ones while side-stepping protocol.
According to the commissioner, this individual named Omor was active in the IEBC server since June 1, 2022, and remained so even after the general election.

"As far as I am aware, the commission had developed any protocol or other guidelines that would indicate circumstances when an already uploaded form 34A from the polling station would be pulled down and be replaced subsequently," Nyang’aya’s affidavit read.
In his affidavit, Nyang’aya questioned what a foreigner would be doing on the IEBC server, yet the commission did not give him the credentials.
" I do not understand what a foreigner would be doing on the IEBC server during the election period nor do I understand why Gudino Omor was always busy on the server at night," Nyang’aya posed
"As far as I am aware, the commission has never given access rights to the IEBC server to Gudino Omor."
Nyang’aya also disclosed that about 370 people whose details are yet to be given to him and other commissioners accessed the IEBC server during the electioneering period.
The commissioner also named three members of the IEBC as the other people who pulled down results from the commission’s server and replaced them with others.
The IEBC staff he named include Moses Sunkuli, Abdidahir Maalim and Gideon Balang who he also said were closely working with the commission’s chairman Wafula Chebukati with helping him process the presidential election results.
