The former Nairobi Governor Mike Sonko has some reprieve after a Mombasa High Court issued interim orders barring the Independent Electoral and Boundaries Commission (IEBC) from printing ballot papers for the Mombasa gubernatorial race.

This is however, pending hearing and determination of a petition filed by Sonko.

A three-judge bench comprising Justices Olga Sewe, Justice S. Githinji and Justice Ann Ong’injo made the ruling and also issued orders stopping IEBC from gazetting the names of candidates in the Mombasa gubernatorial race.

The judges also barred the Wiper Party from nominating another candidate to replace Sonko, also pending a hearing of the petition.

Sonko seeks to overturn the decision by IEBC’s Dispute Resolution Committee (DRC) that barred him from contesting in the Mombasa gubernatorial race.

He filed a petition seeking 9 orders against Mombasa Returning Officer Swalha Yusuf, IEBC’s DRC and the Wiper Party.

Sonko wanted the court to bar IEBC from gazetting the Mombasa gubernatorial candidates, printing ballot papers and compel the electoral body to provide money copies of the degree of all gubernatorial candidates who have been already been cleared to run for the Mombasa governor’s seat.

In June, the court declined to issue conservative orders to stop the IEBC from gazetting and printing the ballot papers for the Mombasa gubernatorial race.
