The charges proposed against former Interior CS Fred Matiang’i’s by the Directorate of Criminal Investigations (DCI) have been dropped by Director of Public Prosecutions (DPP).

In a statement on Monday, the DPP announced it had terminated the charges of conspiracy and publication of false information that faced Matiang’i and his lawyer Danstan Omari.

According to the DPP, the evidence presented by the DCI was not sufficient to support the said charges against the former powerful cabinet secretary and his controversial lawyer.

DCI had proposed that Matiang’i and Omari be charged for conspiracy to publish in the media that his Karen home had been raided by security officials on February 8, and 9, 2023.

The directorate wanted the duo charged for conspiring to commit a felony in violation of Section 393 of the Penal Code and publication of false information against Section 23 of the Computer and Misuse and Cybercrime Act No. 5 of 2018.


But after reviewing the DCI file, the DPP said the evidence, statements and witnesses provided failed to meet the legal threshold to prove the two offences as required by law.

In that regard, the DPP has ordered the DCI headed by Amin Mohamed to close the inquiry file and that no further action be taken by the police against Matiang’i and lawyer Omari.

“Upon independent and thorough analysis of the evidence availed and a review of the statements of the witnesses, the Director of Public Prosecutions found that the evidence provided was not sufficient to sustain the above charges against Dr. Fred Okeng'o Matiang'i and his advocate Mr. Danstan Omani. The evidence provided did not meet the ingredients needed to prove each of the afore-mentioned offences as required by law,” said the DPP.
