The prosecution on Wednesday applied at the Kiambu Law Court seeking to continue holding David Mutai, the key suspect in the Mulot SIM swap fraud, for seven more days.

The application seeking to continue holding Mutai at Muthaiga Police Station to allow police to conclude their investigation was filed by an investigating officer in the fraud case.

The investigating officer, in his affidavit, said the detectives handling the case needed the one extra week to verify the sim cards and also record statements from his other victims.

Prosecution argues the suspect’s life would be in danger is he is released by the court given he was almost lynched by an irate mob when he was apprehended in Kericho last week.

However, Mutai’s lawyers opposed the application by the prosecution saying the investigators in the case had earlier indicated what they would achieve in seven days.

The suspect in the Mulot SIM swap fraud case is expected back in court on Thursday at 10am, according to a directive issued by Kiambu Chief Magistrate Meresia Opondo.

Mutai was arrested in Kericho five days ago and has been linked to an incident in which an MP was defrauded Sh941,000 while he was attending to an official function.

Kevin Kiplagat and Justus Rono, who are said to be Mutai’s accomplices, have also been apprehended in relation to the fraud reported to have taken place on December 1-2, 2022.
