The construction of a controversial high-rise apartment complex in Nairobi’s Lavington suburb has been temporarily halted by the Court of Appeal as it reviews an appeal against the development.

The decision, issued on Monday, comes after concerns were raised over zoning and environmental impacts.

The ruling follows an application filed on January 16, 2025, by Millennium Gardens Management Ltd, along with another party, who represent residents and stakeholders from the area.

Their appeal challenges the ongoing construction by Metricon Home Nairobi Company Ltd, citing potential risks to the low-density residential nature of Lavington.

The neighbourhood, traditionally made up of single-family homes and low-rise buildings, has been the subject of growing concern among residents about the scale and appropriateness of the development.

The applicants assert that the high-rise violates land-use regulations and argue that allowing it to continue could permanently alter the character of the area.

They also claim that construction has been proceeding despite the existence of an active legal dispute, warning of potentially irreversible damage to both the local infrastructure and the planning framework of the neighbourhood.

In light of these concerns, the Court of Appeal issued a 60-day conservatory order, halting all construction activities at the site.

Furthermore, the court has directed the Registrar to facilitate the expeditious hearing of Civil Appeal No. E1010 of 2024 – Millennium Gardens Management Ltd & Another v. Metricon Home Nairobi Company Ltd & Others.

The matter will be given priority, with the court emphasising the need for a resolution within the next two months.
