The case in which former Kiambu County Governor Ferdinand Waititu is accused of irregularly awarding a Sh588 million tender for road construction has been postponed.

This was revealed by the Office of the Directorate of Public Prosecution (ODPP) on Monday saying Waititu’s lawyers sought the adjournment, which the Milimani Law Courts Chief Magistrate allowed.

The former Kiambu Governor, who was impeached by members of the County Assembly (MCAs) in January 2020, is charged alongside 12 others over the irregular tender award.

ODPP said: “The prosecution led by Faith Mwila and Linda Mwamburi was ready with two witnesses. The prosecution has produced 27 witnesses in the case.”


The Milimani Law Court Chief Magistrate has scheduled the hearing of the adjourned corruption case for October 14 with the prosecution lining up 27 witnesses to testify.

The High Court in June froze 18 prime properties and seven motor vehicles owned by Waititu until the case filed by anti-graft body EACC is heard and determined.

Anti-Corruption Court judge Esther Maina barred Waititu, his wife Susan Ndung’u and their firms from selling, transferring or interfering with the seized assets in any way until the case is determined.


The politician is accused of acquiring the said assets totaling Sh1.94 billion using fraudulent means between 2015 and 2020 while serving as Kabete MP and Kiambu governor.

Waititu is further accused of misallocating public funds through issuance of dubious procurement contracts to companies outsourced for services to Kiambu County.

According to EACC, payments for the dubious tenders would then be forwarded to several bank accounts and firms said to be registered in the name of the Waititu and his spouse.
