Justice Smokin Wanjala on Thursday issued a cutting rejoinder to President-elect William Ruto’s lawyer Kioko Kilukumi’s challenge to the Supreme Court judges’ approach to the petition before it.

While appearing for Ruto in the presidential election petition files at the Supreme Court by the Azimio la Umoja One Kenya coalition leader Raila Odinga and his running mate Martha’s Karua, Kilukumi challenged the judges to apply Solominic wisdom to determine who the real winner of the recet presidential election was.

“I wish to ask the court humbly to reflect on the ruling of King Solomon. Just like King Solomon before you, you have two gentlemen here each one claiming a baby. The baby they are claiming is the outcome of the 2022 general election,” Kilukumi said.

Ruto’s lawyer claimed that his client’s win had a clear DNA which was inscribed in the original Forms 34A and Forms 34B.

“Baby Victory has a clear DNA, its DNA is also captured in the original Forms 34A and 34B… don’t divide the baby…Give it to the true mother of this child because no mother would want her baby chopped into two,” he underscored.,” Kilukumi said.

“I ask the court to give the baby to the legitimate and lawful father who is honourable William Samoei Ruto.”

He was referring to the biblical story of two women who fought over a baby after one accidentally slept on her baby and the infant died.

After killing her baby, she claimed the other woman’s baby as her own and they went before King Solomon to solve the matter.

In his infinite wisdom, King Solomon asked his guard to saw the child into two and give each woman a half of the baby

The woman who accidentally killed her baby accepted the King’s directive while the real mother of the child agreed to give up her child to the other woman as long as the baby’s life was spared.

According to the bible in the book of 1 Kings 3:16-28, that is the wisdom King Solomon used to determine who the real mother of the child was.

Kilukumi likened Ruto and Raila to the two women who were fighting over the baby.

In cutting rejoinder, Wanjala told Kilukumi that he had left out the last part of the story where the real mother of the child gave up her child.

“I also remember that one of the mothers who turned out that according to Solomonic wisdom could not have been the mother, was the one saying cut the baby, but the other one said No, let her take the baby because her interests were to preserve the baby,” Wanjala said

“Could you be willing to…” Wanjala posed subtly suggesting Kilukumi to advise his client to give up his win.
