The Chama Cha Kazi party leader Moses Kuria has filed a petition at the Supreme Court against the Azimio la Umoja One Kenya coalition presidential candidate Raila Odinga.

Kuria filed his petition on Monday, the same day the Azimio coalition filed their petition at the same court challenging Kuria’s principal in the Kenya Kwanza Alliance William Ruto’s win.

"Hon Rtd Col Geoffrey Kingangi and myself have today filed at the Supreme Court Petition E006 of 2022," Kuria said.

The former Gatundu South MP alleged Raila used his chef agent Saitabao Ole Kanchory and others to cause chaos at the Bomas of Kenya Independent Electoral and Boundaries (IEBC) tallying centre.

Kuria said Saitabao physically assaulted the IEBC chairman, Wafula Chebukati, during the melee.

“Shortly after entry of the Commission’s Chairman, two other commissioners and the Chief agent gained access to the podium, whereby he threatened and physically assaulted the Chairman and the commissioners in full glare of cameras,” Kuria said.


In the petition, Kuria further claims the chaos at the tallying centre prevented Chebukati from announcing results from several constituencies.

“As a result of the said violence at the National Tallying center, the Chairperson of IEBC was prevented from performing his mandate in that he was unable to announce results from a number of constituencies,” the petition partly read.

Kuria also claimed the events at the Bomas tallying centre posed a threat to the lives of foreign diplomats, observers, IEBC officials and the presidential candidates who were present at the venue.


Based on that, Kuria wants the Supreme Court to hold Raila accountable for election offences and malpractices committed by his agents and therefore dismiss his petition challenging the presidential election results in which Ruto was declared the winner.

“Raila will be disqualified from the Supreme Court Petition as he is not coming with clean hands. Let justice flow like a mighty stream,” Kuria said.

Kuria also wanted the court to order the Directorate of Criminal Investigations (DCI) and the Directorate of Public Prosecutions to investigate Raila and Kachory’s actions and prefer charges against them.
