A Nairobi voter has moved to court seeking to have former Nairobi deputy governor Polycarp Igathe assume office for the remainder of his term and take over from his former boss, Governor Mike Sonko who was impeached. 

Under a certificate of urgency, Patrick Kiiru argues that Igathe’s resignation was never officially communicated to the Independent Electoral and Boundaries Commission (IEBC) and accepted.

According to Kiiru, in his petition, the office of the deputy governor is not vacant based on the fact that Igathe’s resignation letter was not formally submitted to IEBC.

The voter argues that Igathe, who is now the Equity Group Chief Comercial Officer, should have taken over the running of Nairobi County instead of County Assembly Speaker Benson Mutura.

“There being no vacancy in the office of the Deputy Governor, Igathe ought to have assumed office for the remainder of the governor’s term as contemplated under Article 182(2) of the Constitution,” Kiiru argues in his petition.

Igathe’s exit, according to documents filed in court, was also not formally communicated to the Nairobi County Assembly Speaker.

Igathe resigned from City Hall on January 12 following a bitter fallout with then Governor Sonko.
