High Court on Thursday overturned a move by the Independent Electoral and Boundaries Commission (IEBC) to disqualify Karungo Thangw'a from vying for the Kiambu Senator seat.

Justice Rachel Ng'etich set aside the decision by the IEBC dispute resolution committee to bar Thang’wa from contesting since he was impeached as a Kiambu CEC on graft allegations.

Justice Ng'etich agreed with the former Member of the County Assembly that there was no evidence linking to corruption before any court to warrant him being removed from office.

The High Court, in its ruling cited that the decision by the IEBC tribunal to bar him on grounds that he was unfit to hold public office after being impeached holds no grounds.


"This court finds no reason to bar Karungo from vying for the Kiambu senator position," Ng'etich ruled.

The judge directed IEBC to clear the former Kiambu County Executive Committee Member for Youth Affairs and ensure his name is on the ballot with only 33 days to the election.

Thang’wa was locked out of the August 9 senatorial race after the IEBC Dispute Resolution Committee on grounds that his removal from office meant he was unfit to hold public office.


The IEBC tribunal had argued that the UDA party politician’s impeachment in October 2019 remains valid and that he had not successfully challenged in court.

Focus now shifts to the Wafula Chebukati team and whether it will now clear Thang’wa to contest for Kiambu Senator on August 9 despite the ouster by the Kiambu County Assembly.
