The Independent Electoral and Boundaries Commission (IEBC) through its Electoral Code of Conduct Enforcement Committee has ordered Sabina Chege’s matter to proceed to a full hearing.

Sabina appeared before the committee on Tuesday to answer charges over utterances she made in a public rally in Isibuye, Vihiga County on Thursday.

In the said utterances, Sabina responded to a claim that elections were stolen in the Central region in the last general election.

Sabina was flanked by her legal team led by James Orengo, Otiende Amollo and Martin Oloo as well as other political leaders who went to offer their support

IEBC retreated to determine whether they had jurisdiction to hear the case against Sabina after her legal team raised preliminary objections against her charge.

Among the objections stated that the Electoral Code of Conduct Enforcement Committee does not have the jurisdiction to hear the matter before it.

Her legal team had the opinion the electoral code of conduct does not apply to politicians until the official campaign period.

IEBC dismissed the preliminary objections and insisted it was within its jurisdiction to summon Sabina.

“The Court upon examination found that the procedure followed by the Committee and the decision rendered was within its power and thus upheld the same. The Court declined to issue the orders sought by the Applicant and dismissed the petition,” IEBC said.

The Committee ordered the dismissal of the preliminary objections raised by Sabina's counsel and the matter to proceed to a full hearing

"The Committee therefore orders as follows: 1. The preliminary objection raised by the Counsel for the Respondent on 15th February, 2022 is hereby dismissed. 2. Matter to proceed to full hearing," IEBC said.
