The Speaker of the National Assembly, Justin Muturi, has reminded Members of the County Assembly (MCAs) seeking to vie for higher elective seats in the August general election that February 9, 2022, is the date to resign from office.

Muturi said that after attending the Democratic Party’s National Executive Council briefing in Nairobi.

The Speaker told the party officials to ensure current MCAs who would wish to vie for higher seats in the forthcoming elections are not left out on technical grounds.

“I am just taking the liberty to advise the Democratic Party National Executive Council that under Article 99, Clause 2, Paragraph D of the Constitution, a sitting member of the County Assembly must resign six months to the election date, which is tomorrow, February 9 for the August 9 General Election,” Muturi said.

Muturi observed that many sitting MCAs wishing to vie for other higher elective positions might miss the position of the Constitution on the six-month resignation requirement ahead of the election date.

He cautioned aspirants vying on his Democratic Party's ticket to take notice DP will only clear MCAs who have already resigned within the required time.

Kungu Waibara filed a case against Gatundu North MP Wanjiku Kibe wanting her term to be ended by the court on grounds of technicality namely failing to resign as Kiambu County MCA, six months before she contested for her current seat.

The petitioner won the first round of the case in the High Court and the second round in the Appellate Court. However, Kibe moved to the Supreme Court where the case still awaits final determination.
