Chief Justice Koome has named the judges who will preside over the case to determine the implementation of the Competency-Based Curriculum commonly referred to at CBC.

The three-judge bench comprises Justice Hedwig Ong’udi, Justice Anthony Mrima and Justice Anthony Ndung’u.

They have already set February 17, 2022, as the date for hearing the petition case filed by lawyer Esther Ang’awa.

The petitioner argues that the rollout of the CBC was done without proper planning.

Ang’awa cited a lack of appropriate preparation of the teachers for the change in curriculum. This she said might in the long run affect the learning curve.

Ang’awa sued Interior CS Fred Matiang’i, Education CS George Magoha, The National Assembly, Kenya Institute of Curriculum Development (KICD), Kenya Union of Teachers (KNUT) and the Teachers Service Commission (TSC).

The respondents have asked the court to dismiss the case on the basis that children will be affected if the court decided without their involvement first.

The respondents have the backing of the National Parents Association (NPA).

NPA also argues that the petitioner has not considered the compensation of teachers and parents should the court abolish CBC.
