The family of slain tycoon Tob Cohen have filed a petition before the Public Service Commission.

The petition filed through lawyers Dantean Omari and Cliff Ombeta seeks the removal of Director of Public Prosecution (DPP) Nordin Haji from office.

Cohen’s family is accusing Haji of mishandling the murder of Tob Cohen.

Haji is also accused of mishandling other such cases as the Kenya Medical Supplies (KEMSA) the Direct Line Assurance Limited cases.

Gabriel Hannan Van Straten, Cohen’s sister, the petitioner claims despite Haji’s 19 years experience in legal practice he is yet to set foot in any known court since his assumed office.

The petitioners also claim the DPP lacks all requisite experience as provided under the constitution of Kenya.

“The DPP Public Haji lacks all requisite experience as provided for under Article 157 (3) Constitution of Kenya, 2010,” the petition read in part.

The petitioners also claimed that the DPP’s actions are interfering with ongoing criminal investigations by the Directorate of Criminal Investigations (DCI)

Haji has been accused of openly operating with impunity by protecting persons of interest with high social status or who are influential. An example they gave of such individuals is Justice Sankale Ole Kantai. In relation to that, the DPP stands accused of misuse of power and abuse of office.

“That Noordin Haji the DPP herein, has demonstrated such abuse of power and abuse of office by restraining the Director of Criminal Investigations from arresting the Judge Sankale, for his involvement in the murder and subsequent cover-up of the Petitioner’s brother Tob Cohen until and unless the Director of Criminal Investigation gets explicit authorization from him,” the petition reads.

Cohen’s family claimed that the DPP’s directive does not serve the best interest of justice.
