The court has found former Cabinet Secretary for Sports Hassan Wario guilty of abuse of office.

His abuse of office occasioned the loss of public funds during the 2016 Olympic Games in Rio de Janeiro.

Anti-corruption magistrate Elizabeth Juma found Wario guilty for willfully failing to comply with applicable procedures and guidelines relating to the management of public funds.

Wario was charged with 4 counts, the first being engaging in a project without prior planning and three other counts of abuse of office.

Juma said Wario took advantage of his office and added three individuals to the list of the Kenyan Team to Rio and ensured they were paid allowances even though it was not his mandate to do the same.

“The additional names were included after they closed the accreditation… Clearly this was an indicator that the three were not part of the team, Kenya,” Juma ruled.

According to Juma, there was evidence of wastage of public funds and Wario did not have the mandate to include the extra three individuals on the Kenyan team’s travel itinerary.

However, Wario was acquitted of the charge of engaging in a project without planning for the Rio Olympics.

Due to lack of sufficient evidence, the other accused persons were also acquitted of the charges against them save for one Stephen Soi who has been convicted and found guilty of five counts.

The four who were acquitted were the former Sports PS Richard Enkai, former Director of Administration at the Ministry of Sports Haron Komen, Patrick Kimathi and Francis Kinyili.

Wario and Soi will be detained at Gigiri Police Station as they wait for their sentencing on Thursday.
