Mombasa County Governor Ali Hassan Joho is facing a 60 jail term or Sh250,000 fine for contempt of court.

The ruling was issued by Justice Sila Munyao at the Mombasa Law Courts after Joho and Changamwe Member of County Assembly Bernard Ogutu were found culpable of creating chaos and damaging someone’s personal property.

Mombasa businessman Ashok Doshi filed a case at the Environment and Land Court seeking an injunction against Mombasa County Government officers from accessing a parcel of land of which he claimed ownership in 2019.

Joho, Ogutu, politician Omar Mwinyi together with perceived hired goons defied the court order and trespassed the land wreaking havoc.

Ashok returned to court to later to file another complaint against Joho and Ogutu for contempt of the first court order.

Justice Munyao in his sentence said that Joho’s mitigation statement failed to show signs of remorse.

Munyao said that Kenyans are peaceful and would like to see leaders who respect the rule of law.

“Kenyans love peace and would like to live in a country where leaders lead from the front in respecting the rule of law. We want to live in a country that respects the rule of law and obeys a court order,” said Justice Munyao.

The Changamwe MCA was however handed a 14-day jail sentence or a Sh20,000 fine after the court felt that he had shown remorse and seems to have learnt from his mistakes.

Warrants of arrest for the duo have been issued by Mombasa court should they fail to provide receipts of payment of the fines and be taken to Shimo la Tewa prison.

The governor will also pay for the havoc wreaked on the plaintiff during the incident
